This document governs the general terms and conditions of sale of the products marketed through the website www.laylacounter.com (hereinafter, the “Website”).

2. Subject of the contract

These terms govern the distance sale of food products carried out through electronic means pursuant to Legislative Decree No. 70/2003 and the Italian Consumer Code (Legislative Decree No. 206/2005).

The products offered include, by way of example:

  • frozen food products
  • Caviar
  • wines
  • oil

3. Product description

The essential characteristics of the products are described in the relevant product sheets available on the Website.

Product images are for illustrative purposes only and may not accurately represent the final product.

All food products are selected, stored, and handled in compliance with applicable food safety regulations.

4. Prices

Any additional costs are clearly indicated before order confirmation.

The seller reserves the right to change prices at any time; however, the price applied will be the one displayed at the time the order is placed.

5. Purchase procedure

To make a purchase, the user must:

  1. select the desired product;
  2. add it to the cart;
  3. complete the checkout procedure;
  4. confirm the order.

Placing the order implies an obligation to pay.

6. Payment methods

Payment may be made using the methods indicated on the Website (e.g. credit card, Stripe, or other electronic systems).

The Data Controller does not store or directly process payment data, which are handled exclusively by certified third-party providers.

7. Delivery and collection of products

7.1 Frozen food products

Frozen food products:

  • are not shipped, unless otherwise indicated;
  • may be collected exclusively at the premises of the business, during the opening hours indicated on the Website.

The customer is responsible for collecting the products on time. Failure to collect within the agreed time may compromise product quality and safety and does not entitle the customer to a refund.

7.2 Non-frozen products (caviar, wines, oil)

For non-frozen products (caviar, wines, oil):

  • delivery or collection methods are specified in the product sheet or during the purchase procedure;
  • any specific storage conditions after collection are the customer’s responsibility.

8. Liability

The seller shall not be held liable for:

  • improper use of the products;
  • storage not compliant with the instructions provided, after collection or delivery;
  • delays or service disruptions due to force majeure.

9. Right of withdrawal

Pursuant to Article 59 of the Italian Consumer Code, the right of withdrawal is excluded for contracts concerning:

  • goods that are likely to deteriorate or expire rapidly;
  • food products, including frozen products, caviar, wines, and oil, where product integrity is altered or compromised.

Therefore, the right of withdrawal cannot be exercised after purchase, except in cases of defective or non-conforming products.

10. Complaints

Any complaints must be submitted within 24 hours of product collection or delivery by sending an email to the address indicated by the Data Controller, specifying:

  • order number;
  • description of the issue;
  • any photographic documentation.

11. Personal data processing

Personal data are processed in compliance with applicable legislation.

12. Applicable law and jurisdiction

The contract is governed by Italian law.
For any disputes, the competent court shall be that of the consumer’s place of residence or domicile, if located within Italian territory.

13. Amendments to the terms of sale

The seller reserves the right to amend these Terms and Conditions of Sale at any time.
Any changes shall be effective from the date of publication on the Website.
